ALTERNATIVE DISPUTE RESOLUTION – ONLINE DISPUTE RESOLUTION)/ NETCOMM JOINT DISPUTE RESOLUTION


Please note, if you are a consumer and have made a complaint about a contract with T-Data s.r.l s.r.l. (“T-Data s.r.l”) using this site, but it has not been possible to resolve it, T-Data s.r.l will give you information about Alternative Dispute Resolution organisation(s) (ADR, as indicated in articles 141-bis and following of the Consumer Code), stating whether or not it uses these organisations to resolve disputes.

We would also like to inform you that a European platform for online dispute resolution has been set up for consumers (ODR platform). This platform may be consulted at
http://ec.europa.eu/consumers/odr/, where you can view the list of ADR bodies, find the link to each one and start an online procedure to resolve the dispute you are involved in.

According to article 49, paragraph 1, letter v) of Italian Legislative Decree no. 206/2005 (Consumer Code), customers who intend settling a dispute with the trader (i.e. T-Data s.r.l) may use the Joint Dispute Resolution procedure. This procedure may be started if the consumer, after making a complaint with the company, has not received a reply within 45 days, or has received a reply that s/he does not consider to be satisfactory. For all cross-border disputes concerning the adoption, performance and construal of the General Terms of Sale of T-Data s.r.l governing purchases made from this site, if you are resident or domiciled in an EU member state other than Italy, you may establish a European small claims procedure, as governed by Regulation (EC) No 861/2007 of the Council, of 11 July 2007, with the competent court or tribunal, on condition that the value of the claim does not exceed €5,000.00 excluding all interest, expenses and disbursements on the date when the court or tribunal receives the application. In any case, regardless of the outcome of the alternative dispute resolution procedure, your rights to file a complaint through the ordinary courts are not affected, and as applicable, you may also apply for an out-of-court settlement of disputes relative to consumer relations, based on the procedures in Part V, Section II-bis of the Consumer Code.
